1. Introduction

Welcome to Paleon — an educational and scientific mobile application operated by Handelsbedrijf TB and SJR Solutions, both sole proprietorships registered in the Netherlands (“we”, “our”, or “us”).

These Terms of service (“Terms”) govern your access to and use of the Paleon App, its website, and all related services (together, “the App”).

By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, do not use the App.

We may update these Terms at any time by posting the revised version in the App. Continued use after an update means you accept the new Terms.

2. Purpose of the App

Paleon is an educational platform designed to identify, catalogue, and learn about fossils and prehistoric objects using AI technology.
The App allows users to:

• Upload fossil photos for AI-based identification;
  
  
• Read scientific and educational articles;
  
  
• Manage collections of fossil data;
  
  
• (For premium users) access enhanced features and tools.
  
  

The App is not a professional diagnostic tool, scientific authority, or replacement for academic or museum-level fossil analysis.

3. Eligibility and User Responsibility

You must be at least 16 years old, or have permission from a parent or legal guardian to use the App.
By using the App, you confirm that:

• All information you provide is accurate and lawful;
  
  
• You use the App only for personal, educational, or research purposes;
  
  
• You understand that Paleon is provided “as is” without guarantees of scientific accuracy.
  
  

You are fully responsible for your account activity and any data you upload.

4. Acceptable Use Policy

You agree not to use the App in any way that:

• Uploads or distributes content that is illegal, harmful, or infringing;
  
  
• Includes human faces, body parts, or personal data in uploaded photos;
  
  
• Attempts to reverse-engineer, exploit, or damage our systems;
  
  
• Violates intellectual-property rights, privacy, or third-party terms;
  
  
• Uses automated systems (bots, scrapers) to access or copy data;
  
  
• Attempts to bypass filters or misuse the AI scanner;
  
  
• Harasses, abuses, or misleads other users or staff.
  
  

We reserve the right to suspend or terminate accounts that violate these rules.

5. Account Registration and Security

You may be required to create an account to use certain features.
You are responsible for maintaining the confidentiality of your login credentials and must immediately notify us of any unauthorized use.
We are not liable for any loss or damage resulting from failure to protect your credentials.

We reserve the right to reject, suspend, or delete accounts that provide false information or violate these Terms.

6. Intellectual Property Rights

All intellectual-property rights in the App — including AI algorithms, design, interface, text, and visuals — are owned by Handelsbedrijf TB & SJR Solutions or its licensors.

You retain ownership of the photos and content you upload, but by submitting a fossil photo you grant us a worldwide, royalty-free, non-exclusive license to:

• Store and process the photo to provide identification results;
  
  
• Use anonymized versions to train and improve AI models;
  
  
• Retain the data for research and educational purposes as described in the Privacy Policy.
  
  

This license is limited to these purposes and does not transfer ownership of your original images.

7. AI and Scientific Accuracy Disclaimer

The Paleon AI system analyses images algorithmically. While we strive for accuracy, AI results may be incorrect or incomplete.
We do not guarantee the correctness of identifications, rarity scores, or fossil classifications.
All information provided by the App is for educational and entertainment purposes only, not for professional, legal, or commercial use.

We are not liable for any decisions or actions taken based on AI output.

8. Premium Features and Payments

Premium subscriptions (if offered) provide enhanced features such as detailed results or collection tools.
Payments are processed by third-party platforms (Apple App Store, Google Play Store, or equivalent).

By purchasing a subscription, you agree to the platform’s own terms of sale.
We do not store credit-card data.
All purchases are final unless required otherwise by applicable consumer law.

9. Data Protection and Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, store, and process your data under the General Data Protection Regulation (GDPR).
By using the App, you confirm that you have read and agreed to that policy.

10. Termination and Suspension

We may suspend or terminate access to the App, in whole or in part, without notice if:

• You misuse the AI scanner or upload prohibited content;
  
  
• You engage in fraudulent, abusive, or illegal behavior;
  
  
• Required by law or regulatory authorities.
  
  

Upon termination, your license to use the App ends immediately.
We may retain anonymized data for research and security purposes as allowed by law.

11. Limitation of Liability

To the fullest extent permitted by law, Handelsbedrijf TB, SJR Solutions and its affiliates are not liable for:

• Indirect, incidental, or consequential damages;
  
  
• Loss of data, revenue, or reputation;
  
  
• Errors, interruptions, or technical failures;
  
  
• Incorrect AI results or interpretations.
  
  

Your sole remedy for dissatisfaction with the App is to stop using it and request deletion of your data.

Nothing in these Terms excludes liability for death, injury, or fraud caused by our negligence where legally prohibited from limitation.

12. Indemnification

You agree to indemnify and hold harmless Handelsbedrijf TB, SJR Solutions, its affiliates, and employees from any claims, damages, or losses arising from:

• Infringement of third-party rights.

Any disputes will be resolved exclusively by the competent courts of the Netherlands.
